Intellectual Property Protection in UK-EU Cross-Border Operations

By ILC Advisory Group
Regulatory Disclaimer:This publication provides a strategic commercial overview and general guidance under the laws of England and Wales. It does not constitute statutory SRA-regulated legal advice or establish a solicitor-client retainer.

Expanding commercial operations across the UK and EU jurisdictions requires a proactive approach to Intellectual Property (IP) protection. Relying solely on unregistered rights or localized trademarks exposes scale-ups to severe competitive risks.

Following Brexit, an EU Trade Mark (EUTM) no longer provides protection within the UK. Companies must secure parallel trademark registrations with both the UK Intellectual Property Office (UKIPO) and the EU Intellectual Property Office (EUIPO) to safeguard their commercial identity.

Furthermore, cross-border commercial contracts must clearly define the assignment and licensing of IP rights. Ambiguities in software development agreements or joint ventures frequently lead to fragmented IP ownership, stalling future M&A activities or funding rounds.

We advise technology and commercial entities to conduct a comprehensive IP audit, ensuring that non-disclosure agreements (NDAs) and IP transfer clauses are strictly aligned with both UK and EU statutory frameworks.
